These terms govern use of the public Averly Health website. They do not govern clinical care, referrals, patient accounts, prescribing, pharmacy services, medicines supply, payments or services provided through a separate portal. Separate terms may apply to those services.

About Us

Averly Health is a trading name of Magnolia JV Limited. Magnolia JV Limited is registered in England and Wales under company number 17102369. Its registered office is Lumina, Park Approach, Leeds, England, LS15 8GB.

Acceptance of These Terms

By using the public website, you agree to these terms. If you do not agree, please do not use the website.

You should also read our Privacy Notice and any cookie information shown on the website. If you use a linked service, the provider of that service may ask you to accept separate terms.

Website Purpose

The website provides general information about Averly Health, its purpose, its intended services, its work with healthcare and corporate partners, and news or contact routes. It is designed for patients, healthcare professionals, commissioners, corporate partners and other people interested in Averly Health.

The public website does not itself provide medical advice, diagnosis, treatment or emergency support. Information on the website is general and is not a substitute for advice from an appropriately qualified healthcare professional who understands your circumstances.

Do not use the website or general contact form for a medical emergency. Use an appropriate urgent or emergency healthcare service.

Permitted Use

You may use the website for lawful personal or business information purposes. You may print or download reasonable extracts for your own internal, non-commercial reference, provided that you do not alter them or remove ownership notices.

You must not:

  • use the website unlawfully, fraudulently or in a way that harms another person;
  • attempt to gain unauthorised access to the website, its server, accounts or connected systems;
  • introduce malware or other harmful material;
  • interfere with the website’s operation, security or availability;
  • scrape, harvest or copy website content or personal information at scale without permission;
  • misrepresent your identity, authority or relationship with another person or organisation; or
  • use the website or its content in a way that infringes intellectual property, confidentiality, privacy or other rights.
Contact Forms and Enquiries

Information submitted through a contact form should be accurate and relevant to the enquiry. You must have authority to provide information about another person or organisation.

Submitting a contact form does not guarantee that we can provide a service, accept a referral, enter into a partnership or respond within a particular period. It does not create a clinician-patient relationship or a contract for healthcare services.

Please do not include detailed medical information in a general contact form unless the page expressly asks for it and explains how it will be handled.

Accounts and Login Services

A Log in link may take users to a separate service. The operator and applicable terms should be identified before a user enters or creates an account. These Website Terms do not govern a separate portal unless that portal expressly says they do.

Intellectual Property

Unless otherwise stated, the website and its content, including text, design, graphics, software, trade marks and logos, are owned by or licensed to Magnolia JV Limited. Intellectual property rights remain with their owner.

You may not reproduce, adapt, publish, distribute, sell, license or commercially exploit a substantial part of the website or its content without prior written permission, except where the law permits it.

Third-party names, trade marks and logos belong to their respective owners. Their appearance does not grant permission to use them.

Information and Reliance

We take reasonable care when preparing website content, but the website is provided for general information. Information may become incomplete or out of date as services and evidence develop.

Before acting on information about healthcare, commissioning, corporate services or partnership opportunities, you should obtain appropriate advice and confirm the current position with us or the relevant service provider.

Statistics, case studies and outcomes may relate to a particular service, population, location and period. They should not be understood as a guarantee that the same outcome will be achieved in another case.

Website Availability

We may update, suspend, restrict or withdraw all or part of the website where reasonably necessary, including for maintenance, security, legal or operational reasons. We do not promise that the website will always be available, uninterrupted or free from errors.

We may change the website’s content and functions as the MVP develops. Where a change introduces a new service or materially changes users’ rights, we will provide appropriate information and terms before the new function is used.

Website Security

We use measures designed to protect the website, but we cannot guarantee that it will always be secure or free from bugs or harmful code. You are responsible for using suitable device, browser and security protections.

Third Party Links

The website may link to websites, portals or resources operated by other organisations. A link is provided for convenience and does not mean that we control or endorse the third-party service. The third party’s terms and privacy information will apply when you use its service.

Our Responsibility

Nothing in these terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any rights or remedies that cannot lawfully be excluded.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, was caused by circumstances outside our reasonable control, or results from using general website information as a substitute for appropriate professional advice.

If you use the public website for business purposes, we are not responsible under these Website Terms for loss of profit, revenue, business, contracts, anticipated savings, data, goodwill or any indirect or consequential loss arising solely from use of the public information website, to the extent permitted by law.

Privacy and Cookies

Our Privacy Notice explains how we use personal information. Cookie information and any preference control explain the technologies used on the website.

Linking to Our Website

You may link fairly and lawfully to the website’s homepage, provided that the link does not damage our reputation, suggest an association or endorsement that does not exist, or display the website within another site without permission. We may ask you to remove a link where reasonably necessary.

Changes to These Terms

We may update these terms when the website, our services or legal requirements change. The current version and its publication date will appear on the website. Changes apply from the stated date and do not retrospectively remove rights that have already arisen.

Governing Law and Jurisdiction

These terms and any non-contractual dispute arising from use of the public website are governed by the law of England and Wales.

If you are a consumer, the courts that have jurisdiction under applicable consumer law may hear a dispute. If you use the website for business purposes, the courts of England and Wales will have exclusive jurisdiction.

General

If a court decides that part of these terms is unlawful or unenforceable, the remaining terms will continue to apply. A delay in enforcing a right does not waive that right. These terms do not give enforcement rights to anyone other than you and Magnolia JV Limited.
